Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and FUparking (“FUparking”, “we”, “us”). They govern your use of the FUparking mobile applications, our website, and any related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and hold a valid driver’s license to use the Service. You agree that the information you give us when you register is accurate and that you will keep it up to date.

3. What FUparking is, and is not

FUparking is a communications platform. It lets a driver who is about to leave a public street parking space signal their departure, and lets another driver who is looking for a space see that signal and head toward it.

FUparking does not own, control, rent, reserve, sell, or lease any parking space. Public street parking is regulated by the City of New York and is available on a first-come, first-served basis under the posted signs and applicable law. A payment made through the Service is a payment for the information and coordination the Service provides. It is not the purchase of a parking space, a reservation, or any right to occupy a space. We do not guarantee that a space will exist, be legal, be vacant, or still be available when you arrive.

4. Your account

You are responsible for everything that happens under your account and for keeping your login credentials secure. Tell us promptly at support@fuparking.com if you believe your account has been used without your permission.

6. Fees and payments

A driver who claims a space is charged $7.00. A driver whose posted space is successfully claimed receives $5.00. The difference is our service fee. We may change these amounts at any time, and the amounts shown in the app at the time of a transaction are the ones that apply.

Payments are processed by a third-party payment processor. We do not store your full card details. You authorize us and our processor to charge your saved payment method for amounts you incur. Payouts may take several business days to reach your account.

7. Refunds and disputes

If a claim fails because the posting driver did not leave, because the space did not exist, or because of a comparable problem, report it in the app within 24 hours and we will review it. Where we find the claim failed through no fault of yours, we will refund the fee. Our decision on a dispute is final. Repeated bad-faith reports may result in suspension.

You alone are responsible for how and where you park. Reading the posted signs, meters, street cleaning schedules, and any temporary restrictions is your responsibility. FUparking is not responsible for any parking ticket, moving violation, towing charge, boot, fine, or vehicle damage you incur.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, accurate, or error-free, or that any listing is genuine. Location data and travel times are estimates.

11. Limitation of liability

To the fullest extent permitted by law, FUparking and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, personal injury, property damage, or vehicle-related loss arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

12. Indemnification

You agree to indemnify and hold FUparking harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Interactions between users

FUparking is not a party to any interaction between users. We do not screen users beyond what is described in our Privacy Policy, and we are not responsible for the conduct of any user, online or in person. Use common sense and stay in your vehicle where possible.

14. Suspension and termination

We may suspend or terminate your account at any time if we believe you have violated these Terms or created risk for other users or for us. You may stop using the Service and delete your account at any time from the app. Sections that by their nature should survive termination (fees owed, disclaimers, limitation of liability, indemnification, governing law) will survive.

15. Changes to the Service and to these Terms

We may change the Service or these Terms. If a change is material, we will give notice in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction.
